Partnership Agreement For Tour Operators

Partnership Between Trips to Africa Online and Tour Operators

This Agreement sets forth the terms under which the Operator may list, promote, and sell its travel products and services on the Trips2Africa.com platform.

1. Purpose of the Agreement

Trips2Africa is a digital travel marketplace that connects global travelers with licensed tour operators across Africa. By entering this partnership, the Operator agrees to list their services on the Trips2Africa platform and to uphold the responsibilities outlined in this Agreement.

Listing on Trips2Africa is subject to an annual subscription fee, based on the package selected:

  • Safari Package – $99/year
  • Kilima Package – $299/year
  • Uhuru Package – $499/year

The selected package determines the level of visibility, marketing exposure, and platform tools accessible to the Operator. Subscription fees are non-refundable once a listing is approved and published on the platform.

Operators have two options for handling payments:

  1. Operator Direct Payment Option
If the Operator chooses to handle their own bookings, Trips2Africa will direct customer inquiries or bookings to the Operator’s designated platform, website, or contact. No transaction fee is charged by Trips2Africa. However, the Operator must process these payments and bookings independently.
  2. Platform Wallet Option
If the Operator prefers Trips2Africa to process bookings and collect payments on their behalf:
  • Payments are received by Trips2Africa’s secure payment platform.
  • Payouts can be withdrawn by the Operator to their designated account or wallet.
  • Withdrawal Fees (per transaction):
    • Safari Package: $20
    • Kilima Package: $10
    • Uhuru Package: $5

Please note: For international payments made via credit or debit card, a bank processing window of up to 3 business days may apply before funds are available for withdrawal.

  • All operator profiles and listings are manually reviewed and approved by Trips2Africa before going live.
  • Trips2Africa reserves the right to reject listings that do not meet its quality, licensing, or service standards.
  • The Operator is solely responsible for the accuracy of listing content and must ensure all information is truthful, up-to-date, and compliant with tourism regulations.

Trips2Africa serves solely as a marketplace and promotional platform. The Operator retains full and independent responsibility for:

  • Fulfilling bookings
  • Providing quality travel services
  • Managing customer expectations and experiences

Trips2Africa is not liable for any issues, damages, losses, or claims that arise between the Operator and the client as a result of services rendered.

While Trips2Africa does not mediate contract terms between the Operator and clients, we are committed to fair platform practices.

  • In the event of a dispute or complaint, Trips2Africa may offer to mediate communication between the parties.
  • We do not offer refunds on behalf of the Operator and do not assume legal liability for service disputes.

By entering this Agreement:

  • The Operator grants Trips2Africa permission to use their logo, business name, photographs, and descriptions in marketing campaigns, social media, newsletters, and other promotional content.

The Operator affirms they hold all necessary rights to any images or branding provided and indemnifies Trips2Africa from any related claims.

  • This Agreement may be terminated by either party with 30 days’ written notice.
  • If the Operator chooses to terminate after their listing has been approved and published, no subscription fees shall be refunded.
  • Trips2Africa may also terminate the Agreement immediately in the event of suspected fraud, misconduct, or breach of these terms.

Trips2Africa shall not be held liable for:

  • Delays, losses, or damages caused by the Operator or third parties.
  • Disputes arising from service fulfillment or guest satisfaction.
  • Any indirect, incidental, or consequential damages related to this Agreement.

Trips2Africa is not a travel agency or service provider. We do not assume any responsibility for customer experiences beyond the listing and promotion of the Operator’s offerings.

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under or in connection with this Agreement shall be resolved by courts located in Nairobi, Kenya.

This Agreement represents the full understanding between the parties and supersedes all previous verbal or written communications. Any amendments or modifications must be agreed to in writing by both parties.

The Operator acknowledges that they:

  • Have read and understood this Agreement;
  • Agree to be bound by its terms and conditions;
  • Are authorized to enter into this Agreement on behalf of their organization.
